Question

Assume the same facts are present as in paragraph 1 of the Kaufman & Kaufman case presented in Problem. Except, instead of seeking negligence, plaintiffs are seeking a judgment for Gross Negligence.
What must the plaintiffs prove in addition to the requirements of Ordinary Negligence to pursue a successful case against Kaufman & Kaufman? Why would the plaintiffs seek Gross Negligence rather than Ordinary Negligence?
