Bailments can be commercial (such as a forklift lease) or consumer (such as a video rental). Both are bailments for value and therefore governed by a contract. It could be argued that consumers accept whatever terms are offered while businesses are able to negotiate terms. Is this a valid argument? Is there a need for legislative intervention?
