David Kelynack was the proud purchaser of a new Yamaha motorcycle from Anderson Vehicle Sales with a six-month limited warranty. About two and a half months and 3,115 miles after the purchase, a tapping noise in the engine caused Kelynack to bring the cycle in for repairs. The seller agreed that the repairs were under warranty, but through misdiagnosis, a wait for parts, and another wait for additional parts, the cycle was in the shop for two months. At that time, Kelynack informed Anderson Vehicle Sales that the limited warranty was inadequate and he was exercising his right to revoke under the UCC. Three and a half months after repairs began; the cycle was as good as new. Could Kelynack revoke his acceptance and demand his purchase price returned?
