Mary Lou Miller underwent successful surgery to remove kidney stones and repair a malformed right kidney. A Penrose drain (a piece of soft tubing to drain off fluid) was placed to facilitate postoperative healing. A few days later the drain was purportedly removed. During the post-surgery follow-up, Miller reported pain in her right flank and abdomen. A diagnostic imaging report showed there was "radiopaque material in the soft tissues adjacent to the ... right kidney." Part of the Penrose drain remained. Is this an appropriate case for the doctrine of res ipsa liqueur.
