Nastasi drove a propane gas truck for Synergy Gas. He had been active in getting a union certified as the bargaining agent for fellow employees.
The unionization fight was bitter, and the company was cited by the NLRB for five unfair labor practices. Soon after the unionization fight, Nastasi was in an accident in his truck. Synergy fired him, claiming that it fired all drivers in serious accidents because of the danger involved in driving such trucks. The union protested that the firing was because of Nastasi's union leadership. The NLRB ordered Nastasi reinstated to his job; Synergy appealed. What would you think was the result was?
