Real estate broker Donald Alley Sr. had a listing contract that gave him the exclusive right to sell
Wayman Ellison's farm for at least $200,000. Ellison was told that a buyer was found. The buyer, Cora Myers, who had been paid $585,000 for her small farm because the land was needed for a commercial development, agreed to pay $380,000 for the large Ellison farm. Alley told Ellison that the sale price was $200,000. The buyer paid $380,000, however, and Alley kept the difference. When Ellison later learned of these details, he sued Alley for the $180,000.
