On April 23, 2014, Calvin Loyer admitted his wife, Edeltrud Loyer, to a nursing home administered by Signature Healthcare. During the admissions process, Calvin signed an arbitration agreement directed toward Edeltrud on the line entitled “RESIDENT REPRESENTATIVE SIGNATURE.” On May 28, 2014, Edeltrud passed away under Signature’s care. Calvin filed a wrongful death suit, alleging that Edeltrud’s death was the result of Signature’s negligence. Signature filed a motion to compel arbitration based on the arbitration agreement that Calvin signed. The district court dismissed Signature’s motion, and Signature appealed.
