Mohamad Kutite sought to lease a gas station operated by Majors Management.

The closing date for the lease agreement was October 1st.

On September 27th, Majors sent Kutite five documents to sign and have notarized before the closing date. Kutite did so and returned the documents on September 28th. Kutite refused, however, to sign a separate document acknowledging that he would continue using the ATM machine that was already at the gas station. On October 2nd, Majors informed Kutite that if he did not sign the ATM agreement, then the deal was off. Kutite sued for breach of contract, claiming that the agreement had been formalized on September 28th.

Could Kutite unilaterally establish a valid contract simply by returning the five signed and notarized forms?
