Alan Broad bought a new Jaguar automobile. The dealership stated that it would repair any issues with the vehicle in the future. A number of issues developed, and Broad was in and out of the dealership numerous times. When the vehicle was not fixed to his satisfaction, Broad began negotiations with the dealership to buy back the very expensive car. Those negotiations fell through and Broad brought suit. The question before the court was whether a promise to undertake to fix future problems constituted an actual warranty enforceable under the UCC?
