In tort law, punitive damages are available for plaintiffs who are the victims of intentional torts. Contract law damage theory has been reluctant to apply punitive damages in contract cases, even when the breach of contract is egregious. The UCC provides no provision for punitive damages unless the action is also a tort. Should this be altered to permit punitive damages?
