Johnny Franco was involved with part of the Italian mafia for the majority of his youth and often handled illegal drug deals for the family. The local police department convinced Johnny to become an undercover informant and help them arrest leading members of the mafia. Johnny was scheduled to be the prosecution’s star witness at the criminal trials of the mafia bosses. However, the family became aware that Johnny was a “snitch” and began to threaten him. Scared for his life, Johnny took the stand in the courtroom and lied about the family’s involvement in illegal drug dealing. Without its star witness, the prosecution was forced to drop the charges against the mafia bosses. Johnny is now being charged with perjury. Is he entitled to the defense of duress? Why or why not?
