ABC College is a public college in Ontario. Mr. Jones had an excellent grade point average when he graduated, so he was offered a paid placement at the college's legal clinic. Mr. Jones started working at the clinic on May 1, 2021. The placement is not an internship. Although Mr. Jones graduated from the paralegal program, he is taking a course at the college, and he is still registered as a student. ABC College can be considered like a university for research purposes. ABC College has a legal aid clinic for its students, and ABC College has a written contractual agreement with the ABC Legal Clinic to provide paid placements for ten months for its top five graduates. Getting a placement at the clinic was advantageous for students because the clinic had the following policies: 1. Providing learning objectives for each assigned task. 2. Providing oral feedback about each task after it was completed. 3. Providing a report card based on performance. 4. Providing consistent feedback for students with failing report cards. If a student had failing grades in two areas as noted on the report card, the student was placed on probation. The report cards were issued every two months. Mr. Jones's July 2021 report card revealed no problems. In September 2021, Mr. Jones's report card showed that he was failing in three areas, so he was placed on probation. Mr. Jones had not received any negative feedback from his supervisor before receiving his report card, so Mr. Jones was shocked and upset. Furthermore, Mr. Jones was concerned about his placement because the clinic could terminate the placement if Mr. Jones did not receive a passing report card in November 2021. Mr. Jones worked very diligently after his September report card as he wanted to succeed. Mr. Jones met with his supervisor every Friday to review his performance, and the supervisor seemed pleased with the work Mr. Jones was doing. Mr. Jones asked his supervisor if his placement was in jeopardy, and the supervisor assured him that he would be able to complete his placement. On November 1, 2021, Mr. Jones received another failing report card, and his placement was terminated. Mr. Jones appealed this decision to the ABC College Placement Committee. The Placement Committee agreed with the clinic's decision. Decisions of the College Placement Committee can be appealed to the ABC College Final Placement and Academic Committee. There are no further internal avenues of appeal after a decision is rendered by the Final Placement and Academic Committee. Mr. Jones wants to be compensated for his loss of income, and he wants his placement back.
