One day, the employee figured into a vehicular accident while performing his official duties. Can the employee claim casualty loss to reduce his taxable income considering that the loss was sustained in the course of his official duties?

 

 

5. A practicing Filipino accountant filed his 1st, 2nd and 3rd quarter income tax for 2021 claiming optional standard deductions. In the course of the remaining taxable year, he realized that he has enough documents to substantiate his business expenses. He plans to use use itemized deduction for his annual income tax return for 2021 to minimize his taxable income. Will this be allowed by the BIR? Why or why not? 

6. Atty. Matapang is a partner in a general professional partnership. The partnership computes its gross revenues, claims deductions using optional standard deduction, and distributes the net income to the partners, including Atty. Matapang, in accordance with its articles of partnership. In filing his own income tax return, Atty. Matapang claimed deductions that the partnership did not claim, such as purchase of law books, entertainment expenses, car insurance and car depreciation. The BIR disallowed the deductions. Is the BIR correct? Why or why not?
