On 25 march, she published an advertisement in the local newspaper in which she mentionned « Peugeot car for sale. Price to debate. For any acceptance, please contact the newspaper ». Mr. « Buy-All » is interessed to purchase Julie's car. He goes from the day after the announcement the newspaper to notify his acceptance. Unfortunately, he was informed that Julie has withdrawn her proposal. Mr. « Buy-All » is disapointed. He asks the following questions to you : 1. Is Julie's proposal an offer or just an invitation to treat ? (5 points) Julie lives now in the new city. With the help of her parents, she decided to purchase a small house in an old place of the city. According to the seller, the price (1 million EUR) is due to the fact that a famous painter had lived there. This information immediately pushed Julie to acquire the house despite the price. While the contract is already signed, Julie leams that the information about the painter given by the owner was false. She is wondering if she can sue the seller for the voidability of the contract and to get some damages. 2. What would be the legal basis of her action ? (5 points) Julie loves her new town, she decided to open an organic restaurant and signed a contract with a supplier who agreed to supply her with organic fruits and vegetables. Both parties specified in the contract that fruits and vegetables must be delivered on Monday and Friday. The supplier failed to deliver and Julie was obliged to seek for a new supplier for whom she paid more. She is angry and needs your advice. 3. How would you qualify the failure to deliver ? Explain your answer (5 points) To get more money, Julie would like to operate under licensing for her restaurant. Indeed, she thinks that using a name and a know-how of a famous brand can be benefit.
