Case Study Mr. and Mrs. Jones have been married for 25 years. Mr. Jones is about to retire. They hire Noble Contractors to build an addition to their home. They pay an Architect to design the addition. The design meets the requirements of the OBC, but not the City by-laws regarding setbacks. The contract with Noble states that "the Contractor shall be paid for all materials and equipment consumed in performing the contract." Noble presents an invoice for two hammers and three screwdrivers used in the construction of the Jones' home. However, the Jones' refuse to pay, stating that the tools are overpriced and could have been purchased on sale for half the invoice price. Noble sues them for the amount of the invoice. The Jones' also argue that the colour of the tiles is not what they ordered. They are unhappy with the general workmanship and want a refund. Anyway, the City inspector says it has to be torn down as it's in non-compliance to the City by-laws.
