Choice of Law and Forum The following quote is taken from the Legal Services Society website
Question:
Choice of Law and Forum
The following quote is taken from the Legal Services Society website on family law in British Columbia:
"Both the federal Divorce Act and the provincial Family Law Act deal with family law. As well, both the Provincial (Family) Court and the Supreme Court have the jurisdiction to hear cases dealing with family law issues. Deciding which legislation you are going to claim under is making a "choice of law." Deciding which court you are going to bring your claim in is making a "choice of forum." (www.familylaw.lss.bc.ca)
The Attorney General website (same one we used in civil litigation) has a good discussion of family law in Supreme and Provincial Courts. See link on G2.
The Legal Services of British Columbia has a website dedicated to Family Law and has an extensive discussion of choosing the appropriate court for family matters. See link on G2.
