Question:
Cindy and Prince met at a ball. They are both aged 25 and got engaged after a whirlwind romance. The week before their wedding, Cindy discovered that Prince had recently slept with her stepsister Drizella, and Cindy wanted to call off the ceremony. However, Cindy's stepmother, Tremaine, told Cindy that a lodger was due to move into her bedroom, and that she could not continue living in the family home. Afraid that she would end up on the streets, and still in love with Prince, Cindy decided to go ahead with the ceremony, which took place at the local Anglican church.
On the night of their wedding, however, Cindy was disturbed to see that Prince had a strange rash on his genitals. Cindy suggested to Prince that he had probably picked something up from Drizella, but Prince told Cindy he has always suffered from eczema, and it was sometimes exacerbated by stress, and he was very sorry whatever it might be, but they should not have sex until it had cleared up. The next morning, Prince apologised to Cindy and said that the fling with Drizella was the worst mistake of his life. Cindy assured him that he was the love of her life and that she forgave him. They then spent a very happy honeymoon together, although they did not consummate their marriage. When they arrived home Cindy was puzzled to discover that they were not going to the castle that she believed was Prince's home.
The property belonged to his rich cousin, and he in fact lives in a small one-bedroom flat above a fish and chip shop. Cindy is currently sleeping on her Godmother's sofa. She regards her marriage as a horrible mistake and wants to end it as soon as possible.
- What advise should be given to Cindy. is this a voidable marriage?
