Question:
Comparison of homicide law between the USA and UAE
People life’s is not a game on other people hands that’s why there is a punishment for each murder in a deferent spot on the earth. Killing is not easy everywhere in the world, and no one could accept someone to take his life away on a minute, even the murder is running away and fighting because of his life. In each country has deferent laws deferent cultures deferent realigns. For example, murdering in the United Arab Emirates and murdering in the United States of America has deferent punishment on one country than another. The United Emirates located in the Middle East and the capital of it is Abu Dhabi. On the other side, the USA located in North America and the capital of the United State of America is Washington ,D.C. The UAE is a Muslim county and it has non-Muslim religious people in there so it has two deferent courts the Muslim court and the secular law for non-Muslim people.
Homicide is a legal term for the killing of a human being by another human being. More so, the act is not necessarily a crime for example it is justifiable when a police officer kills a suspect for self-defense. The criminal law of United Arab Emirate is derived from two key sources; Modern criminal law and Islamic law (Sharia) based on the Federal Penal Code provisions, whish is comes from the “ Quran”, which is the Muslims Holy book. In the United States, criminal law is a product of constitutional authority and the legislative bodies enact it. Therefore, the paper is going to compare homicide, which under criminal law between USA and UAE (Tounge, 2015). Moreover, will include the deferent punishments for the murder, you will know what is sharia law, the vision of the Christian law, the vision of the “Sharia” law, what the murder punishment would be, and how the justice get the victim revenge from the murder.

It is evident that in the United Arab Emirates, sharia law was a traditional law that allows the killing of other human being and it is not conferred by the state but it has its origins in the Muslim belief that it is accepted by God. It is also clear that many of the laws in UAE are based on the sharia law and the law allows the killing of other human beings for serious crimes such as rape, treason and murder. Recently, drug trafficking has also been considered as a very serious offense and a death penalty is entitled to it. The primary reason why Muslims use sharia law is the fact that they can prevent Muslims from committing crimes that might interfere with the well being of other people.[2]It is also clear that in the USA, the killing of another human being is allowed especially for serious crimes such as armed robbery, murder and rape. Therefore, it is evident that in both UAE and USA homicide is allowed depending on the crime committed by the individual being killed.
It is also clear that in both locations people look at the state to take action against a person who has committed murder so that other people can be prevented from committing murder and that is the primary reason why homicide is allowed in both regions. More so, in UAE there is the sharia law that allows taking the life of another human being and it is based on the Muslim faith. In the USA, there are those who base their argument of taking the life of another human being basing on the Christian belief as it is written in the Bible that Cain took the life of his brother Abel, therefore, there is the need for homicide so that people can be refrained from doing what Cain did.
According to the New York Penal Law Section 125.25, homicide is classified as a first degree murder and it is allowed as a punishment for the serious offenses that are committed by people. However, there are those people in USA who are against the idea of taking the life of another person but a higher percentage of citizens see no wrong in the act. It is also clear that recently Dubai confirmed a death penalty for a man who killed his wife and that is a clear indication that homicide is accepted in the country. It is evident that only 31 states in USA allow the punishment of death penalty while it is not allowed in 19 states and that is something that differentiates it from UAE considering the fact that in UAE most of the nations allow taking away the life of another human being as a punishment for a very serious offence. More so, if the issue is compared between the two regions then one can agree to the fact that most countries in UAE still execute people by hanging, electrocution and beheading as compared to most states in UAE [3]
It is also clear that in the USA many people who have been punished by death penalty are women considering the fact that most of them have been found with offenses of killing their husbands and kids while in UAE it is mostly men who have been punished through the death penalty but if the judgment has been made by use of the sharia law then it is mostly women who have punished in such a manner.[4] It is also evident from research that in the USA many people have been saved from death penalty by presidential amnesties unlike in UAE where it is not easy for a victim to survive through amnesties and that acts as a serious for people to avoid committing serious offenses. In addition, basing on the Muslim faith most countries in the UAE think that taking the life of another human being is justified in the Quran especially if the individual has committed a very serious offence. However, most state in USA do base their faith in Christianity and it is clear beyond a reasonable doubt that the Bible does not allow taking the life of another human being even though they have committed a very serious offence (Hood & Hoyle, 2015).
It is also evident that the UAE are not only making the use of sharia law considering the fact that they have other laws for the non-Muslims such as the secular law and that is a clear indication that most crimes are judged basing on the sharia law. On the other hand, in the USA, it is not easy to find a situation where most crimes are determined basing on religion as most laws that apply there are secular laws. It is also clear that most murder punishments in UAE are through stoning the victim till he or she dies while in the US most murder punishments are through hanging the victim or through the use of lethal injections till the person dies. The main reason why UAE stone criminals of serious offences is the fact that they want then to die in pain so that other people witnessing the incidence will be motivated not to commit the crimes (Hood & Hoyle, 2015). More so, most of the states in the US are abolishing the idea of taking the life of another human being considering the fact that many people are against the act while most states in the UAE are okay with the act for the god of the citizens since if someone is killed because of committing murder then it is clear beyond a reasonable doubt that it will not be easy to find many people committing the act. Therefore, the primary reason why the act is very common in the UAE is to instill fear to those people who like committing serious crimes. It is also clear that some countries impose the death penalty on child offenders of serious crimes despite the direction of international prohibitions while most states in USA only impose a death penalty on adults who have committed a serious offence and not on kids (Hood & Hoyle, 2015). It is also clear that the rates of homicide are falling in major cities and rising in the middle sized ones in the USA but in the UAE the rise is seen in major cities as compared to the middle sized one.[5]
Conclusion
The paper has shed more light on the comparison of homicide law between the USA and UAE and it has been discovered that in both locations people look at the state to take action against a person who has committed murder so that other people can be prevented from committing murder and that is the primary reason why homicide is allowed in both regions.
