Read the Furman v. Georgia case in constitutional law 101 on pages 472 to 489. This was a major case that is a bit lengthy with several justices taking the time to express their views and reasoning. Note the points and support /reasoning in both the majority opinions but also the points and support/reasoning in the dissent opinions. In your paper, address all of the following:
Give a summary of both the majority opinion and reasoning and the dissent opinion and reasoning. Explain.
Select one of the majority views and address the questions asked on page 489 for that justice and his opinion. Be certain to clearly label which one you have selected for full credit.
Do you think those who dissent are most influenced by their view of the death penalty or by their ideas of the judicial function?
Note that there can be a death penalty imposed at the federal and/ or state level. Do you believe it will remain in place at either level throughout your lifetime? Should it be an option or not? If not, what would be the reason and alternative?
