CONTRACT ELEMENTS: Linda and Greg are planning to get married on April 7, 2022. They have decided to book their wedding reception and banquets at the No-Tell hotel.
They have tentatively booked a banquet for 100 people at $100 per person -a $10,000 food and beverage banquet event. They have also put a hold on 50 bedrooms for their guests ( the guests would call and book their rooms independently.
In order to book and hold banquet space at No tell Hotel, Linda paid $1000 in cash ( the required 10% non refundable deposit) signed a contract stipulating payment terms: Linda must pay $4000.00 by 10:00an February 14,2022.
As well,the agreed contract terms stated that by 10:00am February 14 2022. Linda agreed to confirm in writing (via email) the attendee numbers for the wedding banquet.
Furthermore the contract terms stated Linda agreed to pay the final balance of $5000.00 on the wedding day April 7,2022 prior to the event
On February 14, Linda planned to go in person to the No tell Hotel and pay the required $4000 and confirm banquet attendees in person .
She was out the door at 8am, it was very cold outside (-25c) and Linda car wouldn't start. Linda called CAA for battery boost and then phoned No tell hoel leaving a message telling them shw may be late for their 10:00am meeting.
Linda couldn't get her car started and decided to take uber taxi directly to work while calling No tell Hotel, leaving a message stating that she would see them on Thursday February 15,2022.
Linda arrives No tell Motel on Tuesday Feb 15 and met with the catering manager.linda advised him that her numbers had dropped to 80 people for the banquet and that she only needs 20 hotel rooms. The manager accepted Linda's $4000.cheque advising her that he would revise the contract and email to her.
Linda went off to work and when she opened her email she found the following email from No Tell Motel . Unfortunately as you have breached that terms of the contract we have cancelled your booking and have couriered your $4000:00 cheque back to your home address
Linda freaking out and demanded for $1000 deposit back No Tell Motel refused! Linda screamed . I'm suing your all.
Off in small court 1) identify six elements of the contract 2) Rule whether Linda will be successful at getting her $1000.00 deposit back 3) why would a banquet hall do this?
