A reliable informant informed the police that Jeff and Nick went to Florida to purchase drugs. The informant provided Jeff and Nick's photos. The informant stated that the two would come back to New York City by train on September 9th at 3:00 p.m. He stated that Jeff and Nick each would carry a tan zipper bag with cocaine in it. The informant's information provided the police with probable cause. On the day indicated, the police saw Jeff and Nick come out of the train station, each carrying a tan zipper bag. After coming out of the station, the two went separate ways.
- Jeff got into a car dropped to him by someone and drove away. Two blocks from the train station, the police stopped the car. The police ordered Jeff out of the car and seized the tan zipper bag on the passenger seat. The police searched it and found 250 grams of cocaine in it. The police arrested Jeff and searched him. On his person, the police found an illegal gun. The police handcuffed Jeff and placed him inside a police car. The police then searched his car. In it the police found goods stolen from a department store that was broken into two weeks before. It was determined that the car was Jeff's car. At trial, Jeff challenges the admission of the cocaine, the gun and the stolen goods.
- Nick was walking home. Two blocks from the train station, the police stopped him. Nick asked why he was stopped. The police seized the tan zipper bag from him and searched it. In the bag the police found 250 grams of cocaine. The police then arrested Nick and searched him. In his pocket, the police found two diamond rings that were taken from a jewelry store that was robbed three weeks before. At this moment, Nick suddenly started to run. The police gave chase. While running, Nick threw something into a construction site. The police captured Nick and recovered the thing that was thrown away. The thing that was thrown away by Nick was an expense watch, which was also taken from the jewelry store robbery. At trial, Nick challenges the admission of the cocaine, the diamond rings and the watch.
