First, use both the text and Brady v US to explain plea bargaining. What features must a guilty plea have in order to be valid? Which constitutional rights are implicated by pleading guilty? (Make sure you explain how are those rights implicated.)
Second, identify and explain the strongest (in terms of fairness and justice) argument in favor of plea bargaining. Then, identify and explain the strongest argument against plea bargaining.
Finally, what do you think about plea bargaining? Do you find the arguments in favor or opposed to plea bargaining persuasive--why?
As before, the purpose of this paper is to get you to think critically about the readings, come to your own conclusions about the issues and to continue developing your legal reasoning skills. As always, this paper does not have a "right answer." Nonetheless, I do have expectations:
First, I want you to you write well (clearly and concisely written sentences, well-designed paragraphs, no grammar or mechanical errors).
Second, I want you to demonstrate that you are familiar with the reading assignment(s) and that you understand them. Use passages from the cases and/or the text to help you build your case to support your conclusion.
Third, and most important, I want to see that you are developing your own well-reasoned beliefswhatever those beliefs areabout the ideas relevant to your paper topic. To that end, it is not enough to state "I agree with the majority" and then restate their reasons. You need to provide your reasons to explain why you find their argument persuasive and why you do not find the dissent's argument persuasive--or the other way around, if that is the case.
