The plaintiff must be a business invitee who is injured on the premises of some type of business through the owner's (Defendant) negligence. The defendant must be the owner of the property, not a tenant. The case must take place in Delaware as the Plaintiff's complaint will eventually be filed in the Delaware Superior Court. Make sure your Fact Pattern includes information about each of the five elements of negligence: duty, breach of duty, actual cause, proximate cause, and damages.
You must write a fact pattern about the situation in which Plaintiff was hurt due to Defendant's (business owner) negligence. When you write your fact pattern be very thorough in describing not only the injury, but information about Plaintiff and Defendant
