In Hamdi v. Rumsfeld, a plurality of the Court found that: Hamdi cannot be detained because he is an American citizen. A citizen-detainee seeking to challenge his classification as an enemy combatant is entitled to notice, appointed counsel, and an opportunity to be heard. The military properly concluded that Hamdi was an enemy combatant. A United States citizen cannot be an "enemy combatant."
