Writing Assignment Two Spring 2023: The US Supreme Court, LQBTQ and Business Owner's Rights
My life is hectic. For those of you who remember back to my posting in Introduce Yourself early in the semester, I am out the door with Ridley around 5am, working to find clarity and to burn off anxiety before my day starts. It's where I compose much of my day's writing for the Surrogate's Court and, on occasion, a new writing assignment. In early December, as I wandered the snowy dimly lit streets of Oswego, the subject of the semester's second writing assignment appeared.
On NPR's Morning Edition, I heard the following story: Supreme Court Hears Clash Between LGBTQ and Business Owner's Rights. The case,303 Creative LLC v. Elenis, involves Lori Smith, a web site designer, refused to design a web site for a same sex couple's wedding, and was sued for violating Colorado's Public Accommodations Law. In defending her refusal, she argues that the State of Colorado's Public Accommodations Law violates her first amendment rights of free speech and free exercise of her religion by forcing her to engage in speech with which she does not agree, and espousing a view in contravention of her religious beliefs. As succinctly stated in the NPR story: "On one side are laws that guarantee same-sex couples equal access to all businesses that offer their services to the public. On the other are business owners who see themselves as artists and don't want to use their talents to express a message that they don't believe in."
For the second writing assignment, please answer the following:
May a business owner refuse to provide services to individuals based upon their status as members of the LGBTQ community based upon the First Amendment?
Your paper should be three to five pages and should include references to the provided materials and citation to at least three additional outside sources [NO WIKIPEDIA]. Please provide links to your sources in the body of the paper, and provide arguments on both sides of the issue. As always, have fun and be creative, and remember, I am not concerned with ultimate Yes or No answer, rather how you arrive at your conclusion.
