Question:
Jethro was employed by the MCST (Management Corporation Strata Title) of Mont Condominium ("Condo") as a private security guard. The MCST instructed Jethro to request certain information from visitors who enter the Condo, including the visitors' full name, NRIC number and contact details, before allowing the visitor into the Condo. This information was to be recorded in an open visitor log book which is kept on the shelf outside the security guard post so that the MCST manager can access it at any time to review the records relating to the visitors of the Condo.
One afternoon, Debbie (who was a relative of a resident) came to the Condo. When Jethro asked Debbie to provide her full name, NRIC number and contact details, Debbie refused to do so, stating that there are laws or guidelines which prohibit the collection of NRIC numbers. Jethro explained that the request for information is in accordance with the Condo's MCST's instructions, and did not allow Debbie to enter the Condo since she failed to provide the information.
On another occasion, whilst Jethro was on duty one night, a drunk resident (Mike) walked towards him and punched him in the face several times. Unknown to Mike, this episode was captured in the CCTV cameras mounted just outside the security guard post. Jethro had reported the incident to the MCST, and the MCST decided to make a police report. To aid the police in their investigations, the MCST has provided the video recording on the CCTV camera to the police. The video recording clearly identifies Mike as the perpetrator of the assault.
Based on the relevant laws and guidelines in relation to protection of personal data, consider the factual scenario and analyse whether the MCST can do the following:
i. collect visitors' NRIC numbers; and ii. provide the video recording to the police for their investigations.(25m)
