Letty, Brian, Han, Dominic, and Gisele loved driving around town fast and furious. If one happened to be speeding and noticed an officer or a state trooper, they would send signals to others to make them aware. One day, Letty needed a new car so he decided to go to the Speedster Auto Dealer, Inc.. After consulting with Paul, the salesman, Letty purchased a new car for $57,525. Two months after driving, Letty started to hear a certain noise in the car and took it back to Speedster Auto Dealer to complain about the noise. The service department could not find any problems with the car and returned it to Letty. Letty continued to hear the noise over the next several months and continued to take it back to Speedster Auto Dealer. After many months and several visits, Letty decided to take his car and put a giant lemon on the top of the roof. He then drove the car to Speedster Auto Dealer; however, he did not enter the lot, he merely parked his car in street in front of the building. Letty then took out a bullhorn and started screaming, "Speedster Auto Dealer sells lemons. Speedster Auto Dealer sells lemons." He did this for over an hour.

At one point, Letty even walked over to a car that was turning into the parking lot of Speedster Auto Dealer and spoke with the driver of that vehicle. Subsequently, the driver backed his car up and left. Paul, the salesman, Bob, his manager, and Betty, a saleswoman, were watching Letty during this time. Subsequently, Speedster Auto Dealer sued Letty and Letty claimed that he did not do anything wrong because of his First Amendment right to free speech
