On Saturday night, Mr. C decides to rob the restaurant. He drives to the restaurant a few minutes before it closes. He sits in his car, but decides against robbing the restaurant. On Sunday, Mr. C decides to go back to the restaurant to rob it. On Sunday, Mr. C asks another friend of his, Mr. F, to help him with the robbery of the restaurant. Mr. F agrees, and suggests using a stolen car. Mr. C steals a car the day of the intended robbery. Mr. C brings the car over to Mr. F's house.
Mr. F drives Mr. C to the restaurant. Mr. C enters the restaurant, pulls out a handgun, and announces, "No one move- I just want the money from behind the counter." A customer who is present tells Mr. C he won't give him any money. Mr. C points his gun at the customer, and pulls the trigger. Mr. C forgot to load his gun earlier, so the customer is not physically injured.
Mr. C tells the customers to stay where they are for the moment and that he will let them go after he checks for police outside. After a few minutes of looking through the windows for police cars, Mr. C then leaves the restaurant. On the way out, Mr. C pushes a customer who is standing in front of the door. Mr. C has forgotten to take any money from the cash register but sees that someone has left a wallet in the parking lot. Mr. C takes the wallet, and then realizes he needs a car for his escape. He sees a pickup truck nearby. The truck is unlocked with the keys in on the front seat. Mr. C drives away. Mr. C is at a red light, when a person begins to cross very slowly in front of him. Mr. C guns the engine and lurches the truck forward at the pedestrian. The pedestrian ignores Mr. C and finishes crossing the street. Mr. C then drives away. Mr. C gets on to a freeway and is driving at the speed limit of 65 mph. In his haste to get away, Mr. C did not notice that there were several large, unsecured pieces of furniture. While on the freeway 10 miles from the restaurant, several pieces of furniture fall out into the traffic lanes. A driver overturns his car trying to avoid the furniture and is killed as a result. Mr. C continues to drive. Mr. D is the owner of the truck. He had been asleep in the back of the truck and has now woken up. Mr. C looks back at Mr. D and tells him, "Go back to sleep.
