Pilots who serve as required crew-members in Part 135 operations are required under 14 C.F.R.  135.293(a)(1)-(8)5 to pass initial and recurrent oral or written tests in eight specified areas. The FAA determined Ventura Air Services ("Ventura") violated 14 C.F.R.  135.293(a)(1) and (4)-(8),3 by using a pilot on three revenue flights when the pilot had not taken a written or oral test in the subjects specified in those provisions in a timely fashion. The FAA determined that the pilot required recertification training was in Feb based upon initial training. Ventura maintains that this recurrent training course that the pilot took satisfied a requirement in Ventura's reduced initial new hire training program. Additionally, Ventura maintains that the recurrent training course that the pilot took satisfied a requirement in Ventura's reduced initial new hire training program. The pilot completed the first phase of in-house training and the first phase of the Section 135.293 checking module on February 3, year, and completed the last phase of training with the flight check on 16 March 16. Therefore, Ventura maintains the pilot is current through March not February. The FAA disagrees, and the judge agreed, plus issued a $15,000 civil penalty".
