Question:
Stacy lives with her mom (who's got it going on). She is an above-median income debtor who has filed for relief under Chapter 13. Her mother owns a car, which is financed through a local credit union. Because Stacy uses the car to get to and from work, under an arrangement with her mother, Stacy makes the monthly payments. In her schedules, Stacy has claimed the local IRS standard amount for "transportation ownership" in addition to the "transportation operation expenses." The trustee has objected since Stacy is not obligated under the promissory note. Is this a permissible expense for purposes of calculating projected disposable income?
