Question:
- Tara, an elderly woman, was at an ATM cash machine about to make a cash withdrawal. Zahar, who was standing close behind Tara, pushed her causing her to stumble and fall. Tara's debit card fell to the ground. Zahar pretended to be concerned and helped her to stand up. While doing so, he took the debit card and walked away.
Later that day, Zahar booked a night at a hotel and used Tara's card to pay for food and drinks at the hotel bar. The next morning, Zahar was in the hotel lobby when he spotted a door marked, 'staff only'. He went in the room, grabbed some cash and a charity box and then ran out. While the hotel receptionist was busy at the desk, Zahar slipped out of the hotel without paying for his bill.
Zahar used the charity box to collect money but kept the proceeds, deciding as he was poor that he was a deserving case in need.
Advise Zahar on his criminal liability, if any.
