The Justice Firm was recently contacted by Jessie Rider, who was a passenger on a commercial bus
Question:
The Justice Firm was recently contacted by Jessie Rider, who was a passenger on a commercial bus line called Big City Express. Big City Express is a national corporation licensed to do business in your state, as well as throughout the United States. Their home office is in Fargo, North Dakota.
On July 4th of last year our potential client was riding from our state capital to Washington, DC to celebrate Independence Day on the National Mall. As the bus was leaving our home state, it was involved in a collision with a moving truck owned by We-Haul-It-All, a locally owned company that rents moving trucks and equipment to people who want to move their homes by themselves. We-Haul-It-All does not operate outside of our home state. The accident caused both vehicles to leave the road and strike an embankment at a high rate of speed, causing a sprained wrist for Ms. Rider, as well as a concussion and other injuries. Both the driver of the bus, Bess Driver, and the driver of the rental truck, Ron Renter, were cited for reckless driving, although neither of those drivers have been to court yet for the tickets.
As you prepare for the intake interview, what we should be looking out for regarding the following questions:
- Do we have a choice here between filing in state court or federal court? Explain why or why not.
- Is it possible there are multiple defendants we could sue in this case? Please identify all possible defendants, and the cause of action that we could use to sue each of them.
