Question:
Toledo Police respond to a call of a person hit by a car. When the unit arrived, the Fire Department was on the scene treating the person hit. The victim was interviewed, at which time he stated that a white woman driving a Honda Civic started following him. He said that she was flagging him down. When he rolled the window down, the woman stated he had items falling off his trailer. When he got out, the woman hit him with her car and then drove off.
You then locate the alleged suspect. Her story is that the alleged victim was actually following her and was driving aggressively. She states that he was screaming at her, tailgating her and then blocked her in the driveway. She says she got scared, tried to get out of her driveway away from him and accidentally bumped him. She says she is pregnant and was afraid of him.
You have now been referred this case from Court to write a Presentence Investigation (PSI):
How do you proceed at this point? How do you find out what really happened? You are only talking to the defendant in this first interview. What techniques will you use? What will you say?
What will you ask the alleged victim when you call?
How do you figure out what really happened with no witnesses. The only thing you know FOR SURE is that this man was bumped by this woman's car.
Agree or disagree with this recommendation and justify your response. WHY do you agree or disagree? What else would you recommend? Would you take anything out?
