You and your client are in Arizona. Your client bought a new car a few months ago
Question:
You and your client are in Arizona. Your client bought a new car a few months ago and financed in through Last Interstate Bank. The client has been having trouble making payments and is a few months behind. He had been delaying making payments because he knew he was going to inherit a bunch of money pretty soon and was going to pay the whole thing off.
Last night, the bank repossessed the car from the client's driveway. The bank had demanded he get caught up but never demanded he pay for the vehicle in full, something also known as "accelerating the payments." Your client thinks the bank should have accelerated the payments before repossessing the car. If they had, he could have paid it off.
Was the bank within its right to repossess the car without accelerating the payments?
