You are required to search any news source (newspapers, magazines, online publications, etc.) and obtain one news item that reports on an Ontario event where a business has been sued (or will probably get sued) for negligently causing damage. You do not need to find a court decision, as litigation may be pending (not yet decided by a court).
Use your source to analyze the following points:
- Introduction - What is your selected topic? What are the relevant facts? Provide a one-sentence explanation of your conclusions on negligence and risk-management.
- Negligence analysis - Provide your analysis on the law of negligence as it applies to the actions of the business. Specifically, use the four step process for proving negligence and apply it to the facts of the case that you have chosen. Include your opinion on whether the business is negligent and provide reasons for your opinion. (See DuPlessis, chapter 11).
- Risk managemet plan assessment- Did the business have a risk management plan in place?
If it did have a plan, outline the elements of the risk management plan. How could the plan be improved to avoid this type of incident in the future? Use the 4-step process in DuPlessis, chapter 3 to support your answer.
