Nettie Effron, a Florida resident, bought a 16 day cruise of the Brazilian coast from Sun Line Cruises. The cruise was on the SS Stella Solaris, owned by Sun Line Greece. The cruise ticket stated that "any action against the carrier must be brought only before the courts of Athens, Greece, to the jurisdiction of which the Passenger submits himself formally excluding the jurisdiction of all and other court or courts of any other country." Effron was injured when she fell while on the ship. She sued for damages in federal court in New York. Sun Line moved to have the case dismissed because of the forum selection clause in the ticket. The district court refused to dismiss; Sun Line appealed.
