Décarie Motors Inc. operated a business selling automobiles on or near Décarie Boulevard in the City of Montreal. They applied for and obtained the registration of the trademark “Décarie Motors” in 1993 and the term “Décarie” in 1995. This appeal deals with an application brought by GM to have that trademark registration of “Decarie” expunged. Note that “Décarie” was a surname, but had been in use in that business since 1972.
