A Walmart store policy prohibited solicitation during employees’ work time regardless of the cause or organization. An employee came to the store while off-duty with union authorization cards, wearing a union T-shirt that read: “Sign a card . . . ask me how!” on the back. A store manager escorted him out of the store. The next day, while on duty, the employee invited other employees to a union meeting. As a result of these two incidents, the employee was “verbally coached” that he violated the store’s no-solicitation rule. Verbal coaching is the first step in Wal-Mart’s progressive discipline process. Were the employee’s actions protected under the NLRA?
