1. Mary has had a drug problem for many years. C.B. has been removed from Mary's care on several occasions but Mary always complies with her court-ordered treatment plan. Mary again gets caught with illegal drugs and C.B. is once again removed from her care. When should the state have the right to terminate her parental rights? When do your state statutes allow for termination of parental rights? Should the State consider Jason as a custodial parent if he has never exercised his parenting responsibilities?
2. The cases of Baby Richard and Baby Jessica highlight the struggle between an adoptive parent's rights and a natural parent's rights. This is one reason why the process of adoption requires strict adherence to state law. However, why should a child be taken away from loving adoptive parents simply because one of the natural parents lied about the identity and/or existence of the other natural parent?
