Do the following scenarios constitute a valid agreement under Article 2 of the UCC?

1. Wholesaler delivers 1,000 iPhones to Retailer on the 15th of each month. Over a period of six months, Wholesaler has delivered the iPhones on or about the 15th of the month and Retailer has sent Wholesaler a check within 10 days. Assume that in the smartphone industry, payment is generally made within 10 days after delivery. In month seven, Wholesaler delivers the product on the 15th, but Retailer refuses to pay, arguing that it did not subjectively intend to have the iPhone contract linger into seven months. Is there an agreement?

2. Retailer agrees to purchase all its iPhones and iPhone accessories from Wholesaler during the next calendar year, but Retailer does not specify the actual number of iPhones or accessories it will purchase. Is there an agreement?
