He wrote nine checks on the firm’s checking account payable to “Bank of the United States.” The law firm was not a customer of the Bank, but Able was. He deposited these checks into his personal account at the Bank and, of course, spent the money. The law firm sued the Bank to get its money back. Was the Bank liable to the law firm? Was it a holder in due course of the checks?
