He had also stated on his application that he had no criminal history. Although the stated policies of both the contractor and the staffing firm were to conduct criminal background checks on all persons hired, the man was hired without a background check. About a month later, a female technician working at the same clean-up site became ill during the workday. As the man had been scheduled to work only a half-day that day, he offered to drive her home. On arriving at her home, the man allegedly forcibly raped the woman. The woman sued. Are the contractor and/or staffing firm liable for negligently hiring the employee who perpetrated this act?
