Barbara Kaiser had surgery to implant the Prolift Anterior Pelvic Floor Repair System, a medical devicethat supports the pelvic muscles. Within a few years, Kaiserbegan suffering severe pelvic pain. Kaiser’s physician attributed the pain to the Prolift and told her that the pain was likely permanent,because, in her situation, as with some other patients, it was impossible to remove the device safely. Kaiser filed a strict product liability suit in a federal district court against Ethicon,the maker of the Prolift, and Ethicon’s parent company Johnson & Johnson, to recover for her injuries. At the trial, pelvic-floor surgeons testifying on Kaiser’s behalf revealed that they had not known of the risks associated with the Prolift and “once [they]found out about them, [they] stopped using it.” What made this product so defective as to be unreasonably dangerous?
