An occupational therapy graduate student at the University of New England (UNE) injured her back during a practical exam when her instructor, playing the role of a patient, allegedly feigned a fall while the student was attempting to assist in transferring him from a wheelchair to a bed. The student failed the practical exam and the course. She was later dismissed from the program. She then filed suit against UNE and the instructor, asserting claims of negligence against both defendants and breach of contract against UNE.
