Underlying the assumption of the risk doctrine is one of the central philosophical themes in this book: To what extent should the law shield us from life’s risks? Departing for a moment from product liability considerations, how should the law resolve disputes arising from potentially hazardous recreational activities entered freely? Gabriella Ballou, then a 9th grader and experienced cheerleader, allegedly improperly performed the “prep cradle twist,” causing her head to miss the safety mat and strike the floor. An expert witness testified that the stunt was inadequately supervised, among other problems.
