1. I once appeared in the Eastern District of New York Bankruptcy Court before Judge Conrad Duberstein. Judge Duberstein was one of the original drafters of the U.S. Bankruptcy Code so it was a great honor to argue before him. I was appearing to argue for my client, a patent owner who had been in negotiations for a patent license with the company now filing for bankruptcy. I had originally planned to argue how the company clearly infringed the patents and thus my client deserved to be listed as a creditor. As soon as I started to make my arguments, Judge Duberstein retorted "If you mention the word patent one more time in my courtroom, I will kick you out and throw you across the street." (He actually said this in a very kind and jovial manner, but is took me by surprise.) I soon remembered that the Federal District Court for the Eastern District of New York was located across the street. I quickly changed my arguments and ultimately got my client listed as an unsecured creditor (though he never saw a dime). Why was this kindly old man going to toss me into mid-day Brooklyn traffic?
