As you may have heard, Yesenia Cruz, the President and CEO of Impacto Media, Inc., recently announced her intention to run for Governor of Florida in 2026. The announcement was accompanied by the formation of an exploratory committee, a necessary preliminary step toward a gubernatorial campaign.
Ms. Cruz's exploratory committee has retained our firm to represent her in connection with various legal issues that are expected to arise during her campaign. The first issue we have been asked to analyze is whether Ms. Cruz is qualified to serve as governor. The Florida Constitution requires the governor to have resided in Florida for the preceding seven years as of the date of the election.
While Ms. Cruz was born, raised, and educated in Florida, she has lived much of her adult life in California. From 2012 to 2019, she was Vice President of Impacto Media, Inc., a Spanish-language film and television company. Impacto's headquarters are in Miami, but it has large offices in New York and Los Angeles as well. During this time, Ms. Cruz lived with her family in the Brentwood area of Los Angeles and worked in Impacto's Los Angeles office.
In June 2019, Ms. Cruz was promoted to CEO of Impacto, and she began the process of wrapping up her job in California and relocating to Miami. Ms. Cruz has stated that she hopes to work for Impacto "for years to come" and has no plans to leave Florida, other than for vacations and business trips, between now and the November 3, 2026, election.
As the attached documents illustrate, it is not entirely clear when Ms. Cruz will be deemed to have moved to Florida for purposes of beginning her seven-year residency period. I would like you to research Florida law and prepare a memorandum analyzing whether Yesenia Cruz will satisfy the seven-year residency requirement set forth in the Florida Constitution, assuming she continues to reside in Florida through the 2026 election.
