Question:
McGyver runs a hot air balloon company in Liverpool that takes customers on flights. He hears that Murdock has inherited a hot air balloon from his aunt Penny. McGyver asks to inspect the balloon, finds that it has a Flight Safety Guarantee from the Ministry of Transport in a compartment in the basket of the balloon, and agrees to buy it. Subsequently, McGyver discovers that the Flight Safety Guarantee documentation was faked by aunt Penny, a matter about which Murdock was unaware. McGyver is very disappointed, as this means the balloon will probably never fly or take on customers - while not illegal to fly, he knows no insurance company would insure him. He argues that he would never have entered into the agreement with Murdock had he been aware of the fact the Guarantee was faked.
Some weeks later, Pete contacts McGyver about a balloon ride from his existing fleet to Bouncie Mountain, to take a small school group of geography students to look at rock formations. McGyver informs him orally that one ride would cost about 1000 for the group. However, when Pete gets the terms in the post, he discovers that McGyver has written 10.00 as the cost of a ride. Pete signs the agreement. When he turns up to the airfield with his class, he states to McGyver 'I don't care about any errors you made. A contract is a contract. You must accept 10 and take my class to Bouncie Mountain.'
Question 1:
Advise McGyver as to whether his errors mean either contract can be voided. He has requested a thorough examination of the legal possibilities.
Ensure to provide as many cases to support the answer. Ensure to break down the legal possibilities.
