Scenario: Training rules for a small NCAA Division II college men basketball team state that a player should not drink alcohol during the competitive season. A player who lives in a college dorm had an open bottle of beer found outside his door by the dorm director. The beer was open and half full. The dorm director called the head basketball coach and informed him of the situation. The coach then called the player and asked to see him in his office as soon as possible. When the player arrived, the coach asked the player if the open beer was his beer. The player said that the beer was not his beer and he knew nothing about it. The coach said to the player, "Where there is smoke, then there must be fire." The coach immediately suspended the player from the team for the rest of the season. He also told the player that his scholarship would be taken away. As a result, the player became very upset and he contacted his parents immediately. The parents then called their attorney. Questions: What are the issues in this case that relate to due process and basic components of the 5th Amendment? Do you feel that the coach is standing on solid legal ground? Explain. Do you feel that the player may have a legal case? Why or why not? Explain. O If this case makes it way to a trial, who do you think will win? Why?
