Following the 9/11 terrorist attacks, the U.S. government, through the National Security Administration (NSA), began a program of systematically monitoring communications suspected to be related to terrorism. The NSA did so without obtaining search warrants. One justification offered was that the "war on terror" made necessary warrantless searches legitimate under the Fourth Amendment. What reasons might the federal government have for not seeking warrants prior to monitoring phone or e-mail communications?
